An Employment Authorization Document is also known as an EAD or work permit. Applicants can obtain this document by filing Form I-765 with the United States Citizenship and Immigration Services (USCIS) for more than 40 categories. These categories include applicants seeking adjustment of status, those seeking temporary protected status, and spouses of E-1, E-2, L-1A, L-1B, etc. Eligibility for an EAD is determined under 8 C.F.R. §274a.12.


An EAD is a plastic card, about the size of a credit card, that contains the cardholder's personal information, alien number, and expiration date. In some cases, an EAD may also contain "advance parole" information, which allows the holder to travel internationally and return to the United States. EADs marked "valid for reentry into the United States" can also be used as advance parole.


On April 4, 2024, the U.S. Citizenship and Immigration Services (USCIS) issued a temporary final rule (TFR) that extends the automatic extension of certain employment authorization documents (EADs) from up to 180 days to up to 540 days.


For eligible foreign nationals, the applicable automatic extension will apply to timely renewal Form I-765 applications filed on or after October 27, 2023, that are pending on April 8, 2024. The extension will also apply to eligible applicants who submit renewal EAD applications between April 8, 2024 and September 30, 2025.


EAD categories eligible for the automatic 540-day extension include the following:


Adjustment of Status (C09)


Temporary Protected Status (TPS) (A12 or C19);


*Refugees and Asylum Seekers (A3 and A5);


Noncitizens who have properly filed a petition for asylum and withholding of removal or removal (C08);


Self-petitioners approved under the Violence Against Women Act (VAWA) and their qualifying children (A31);


H-4 spouses with a valid H-4 I-94 (C26);


E-1, E-2, and E-3 spouses who hold a valid accompanying I-94 (A17) do not need to apply for an employment authorization (EAD) because their E-1S, E-2S, or E-3S status automatically qualifies them to work; and


L-2 spouses with a valid L-2 I-94 (A18), noting that these individuals do not need to apply for an EAD because they are authorized to work under their valid L-2 status.
